Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the FigBloom property management platform (the "Service"), operated by FigBloom Digital Group ("FigBloom", "we", "us", or "our"). By creating an account, accepting a workspace invite, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service is a multi-tenant platform that lets property managers and landlords/owners manage properties, units, and leases; lets caretakers handle maintenance and inspections for properties assigned to them; and lets tenants view leases, pay rent, and submit maintenance requests. Each organization's data is organized into a "workspace," and access within a workspace is scoped by role (property manager, owner, caretaker, tenant).
2. Accounts & Roles
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must provide accurate information when creating an account or accepting a workspace invite.
- A workspace's property managers and owners are responsible for the accuracy of property, lease, and tenant data they enter, and for how they use tenant data within the Service.
- We may suspend or terminate accounts used in violation of these Terms.
3. Payments
Rent and fee payments processed through the Service are handled by third-party payment providers (M-Pesa via Safaricom, and card payments for FigBloom subscriptions via Stripe). FigBloom is not a party to the underlying tenancy agreement between a landlord/owner and a tenant, and is not responsible for disputes over amounts owed, refunds, or the terms of any lease. Payment confirmations and receipts generated by the Service reflect data received from these providers and are provided for record-keeping convenience.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, or to submit false property, lease, or payment information.
- Access or attempt to access data belonging to a workspace, property, or tenant you are not authorized to view.
- Interfere with or disrupt the integrity or performance of the Service, including by attempting to bypass access controls.
- Use the "Sophie" AI assistant to submit content that is unlawful, abusive, or that attempts to extract data you are not otherwise authorized to access.
5. Your Data
As between you and FigBloom, a workspace's property, lease, tenant, and financial records remain the property of that workspace. We process this data to provide the Service, as described in our Privacy Policy. On termination of an account or workspace, we will make reasonable efforts to retain or export data as required by law or as agreed with the workspace administrator.
6. Service Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. Features that depend on third-party providers (payment processors, SMS/WhatsApp delivery, live notifications) may be affected by outages outside our control. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.
7. Limitation of Liability
To the fullest extent permitted by law, FigBloom will not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including disputes between landlords/owners, property managers, caretakers, and tenants, or losses arising from third-party payment or messaging providers.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access to the Service, in whole or in part, if we believe these Terms have been violated, or as needed to protect the Service or its users.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms. Material changes will be reflected by updating the effective date above.
10. Governing Law
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles.
